These Terms of Service ("Terms") govern your use of the Final Drive Flag Football mobile application ("the App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You may use the App for personal, non-commercial entertainment. You agree not to cheat, exploit, reverse-engineer, tamper with the App or its servers, or use unauthorized software to gain an advantage or disrupt other users.
The App and everything in it that we created — including its artwork, player cards, characters, names, logos, audio, and code — is owned by us and protected by intellectual property law. You may not copy, extract, resell, redistribute, or commercially exploit any part of it, or use it to make or promote another product, without our written permission.
You are responsible for keeping your account credentials secure and for activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.
The App includes virtual coins, card packs, player cards, and other in-game items. These items have no real-world monetary value, cannot be exchanged for cash, cannot be sold or traded outside the App, and are licensed to you for personal, non-commercial use within the App only. We retain ownership of all in-game items and may modify, manage, or remove them as part of operating the game. Player cards made from a real person's likeness are also governed by section 7.
In-app purchases are processed and managed by Google Play. All sales are subject to Google Play's terms and refund policies. Purchased virtual items are generally non-refundable except where required by law or by Google Play policy.
Some items, such as card packs, contain randomized contents. The relative probabilities of obtaining items by rarity are disclosed within the App on the relevant drop-rate or pack information screen before purchase.
If you publish custom players or other content to the community pool, you grant us a non-exclusive license to host and display that content within the App. You are responsible for the content you publish and must not submit anything unlawful, offensive, or infringing, or content that uses another person's name, likeness, or photo without their permission. Submissions of a real person's likeness for a player card are covered by section 7 instead.
This section applies if you submit a photo to appear as a player card in the App (for example, through the "Build Your Card" enrollment form). It is the agreement between you and us about your likeness and the card we make from it. Where this section and any other part of these Terms conflict, this section controls for player cards.
7.1 Voluntary, unpaid enrollment. Submitting your likeness is free and entirely voluntary. No fee, wage, royalty, revenue share, or other compensation is owed by us to you, or by you to us, for creating, publishing, or continuing to display your player card. You are not our employee, contractor, agent, or partner, and appearing in the App does not make you a sponsor or endorser of it.
7.2 The license you grant us. By submitting your photo and checking the consent boxes on the enrollment form, you grant us a perpetual, worldwide, irrevocable (subject to section 7.6), royalty-free, sublicensable license to: use, reproduce, adapt, and modify your submitted photo for the purpose of creating a player card; render your likeness into comic or illustrated artwork; use your name, chosen handle, jersey number, position, claimed championship titles, and likeness on and in connection with that card; and display, distribute, and promote the card within the App, on our website, in app-store listings, and in trailers, screenshots, social posts, and other material promoting the App. You confirm you have the right to grant this license.
7.3 What you must warrant. You represent and warrant that: the photo is of you and you own or have permission to use it; you are at least 18 years old, or a parent or legal guardian has reviewed and approved your submission; no other identifiable person appears in the photo without their permission; the photo does not include third-party logos, team marks, copyrighted artwork, or photographer credits you lack the rights to; and any championship title you claim is true and accurate. You are responsible for anything you submit in breach of this.
7.4 We own the card. The player card we create is our work. All right, title, and interest in the finished card — including the comic-rendered artwork, the card frame and design, the tier presentation, the serial number, the assigned ratings and stat line, and any derivative or promotional version of it — is owned exclusively by us, along with all copyright and other intellectual property rights in it. You keep whatever rights you already held in your original submitted photo; you acquire no ownership interest in the card itself. Nothing here transfers your underlying rights of publicity beyond the license granted in section 7.2.
7.5 No commercial use, no resale, no cash value. Player cards are in-game collectibles. They have no real-world monetary value, are licensed to you for personal, non-commercial use inside the App only, and are not transferable outside it. You may not, and may not help anyone else: sell, resell, rent, auction, trade for money or anything of value, or offer as a prize any player card, card account, or card artwork; reproduce the card art on merchandise, prints, apparel, or other goods; mint, tokenize, or list any card as an NFT or other digital asset; sublicense, publish, or distribute the card art outside the App; use the card, its art, or your appearance in the App to advertise, endorse, or promote any product, service, business, team, event, or fundraiser; or represent that we sponsor, endorse, or are affiliated with you or your activities. This applies to your own card as much as to anyone else's. Ordinary personal sharing — posting your card on your own social accounts, non-commercially, without altering it or implying our endorsement — is permitted.
7.6 Withdrawing consent and removal. You may ask us at any time to remove your card and stop using your likeness by emailing the address in section 12. We will stop distributing your card in future releases and updates of the App within a reasonable period after we receive your request. Because the App is distributed as installed builds and may be cached by app stores, copies already downloaded to other users' devices cannot be recalled, and we may retain archival copies and enrollment records as needed for legal, security, and accounting purposes. Removal ends your card's distribution going forward; it does not transfer ownership of the artwork to you.
7.7 Our editorial control. We decide whether to create a card at all, and we may verify, decline, edit, re-rate, re-tier, rename, delay, or remove any card at our discretion. World Class and National tiers are verified against the title you list before the card goes live. We may remove a card and revoke associated rewards if a claimed title is false, if a submission breaches section 7.3, or if we believe the card is being used commercially in breach of section 7.5.
7.8 Release. To the extent permitted by law, you waive any right to inspect or approve the finished card or the material it appears in, and you release us and our licensees from claims arising out of the permitted use of your likeness under this section, including claims of defamation, false light, invasion of privacy, right of publicity, or misuse of likeness. You agree not to seek any injunction that would stop the App from being distributed.
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or free of bugs.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including loss of progress, data, or virtual items.
We may update, modify, or discontinue features of the App at any time. We may also revise these Terms; when we do, we will update the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. The version of the player-card terms you agreed to is recorded with your enrollment submission.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions.
